The Consumer Guarantees

The Consumer Guarantees Act is a cornerstone piece of legislation. Its role is to protect consumers. Under the Act, your consumer rights are expressed as a series of â€Å"guarantees† that a seller automatically makes to you when you buy any goods or services ordinarily purchased for personal use.In this guide, we explain what those rights are, and what to do if you think your rights have been breached. The Consumer Guarantees Act 1993 A Summary Introduction: The Act came into force on 1 April 1994 and does not apply to any contract for the supply of goods or services made before this date (Section 56). It is a significant piece of legislation and is aimed at imposing guarantees in contracts for the supply of goods and the performance of services for the consumers benefit. It provides a right of redress against suppliers and manufacturers in respect of any failure of the goods or services to comply with the guarantees. Definitions: Certain terms are defined in the Act itself (Section 2). These definitions are important in determining in what circumstances the Act will or will not apply. The Act defines â€Å"Goods†, â€Å"Service†, â€Å"Supplier†, â€Å"Manufacturer†, â€Å"trade†, and other terms. The key definition in the Act is â€Å"Consumer†. This is defined to mean a person who:- (a) Acquires from a supplier goods or services of a kind ordinarily acquired for personal, domestic, or household use or consumption; and (b) Does not acquire the goods or services, or hold himself or herself out as acquiring the goods or services, for the purpose of: (i) Re-supplying them in trade; or  (ii) Consuming them in the course of a process of production or manufacture; or (iii) In the case of goods, repairing or treating in trade other goods or fixtures on land.† The definition of â€Å"Consumer† is unusual and difficult. The focus is the ordinary use for which goods or services are acquired rather than the use intended by the acquiring purchaser. By way of example a contract for the supply of crockery to a company that owns a restaurant will be a contract of supply of goods subject to the Act because although intended for commercial use, crockery is ordinarily acquired for personal, domestic or household use and consumption. As far as the services supplied by travel agents are concerned it would be best to proceed on the basis that virtually all of the services will be viewed as a kind ordinarily acquired for personal or domestic use or consumption with the consequence that the Act will apply to those services. Guarantees: The Act establishes one set of guarantees which apply in relation to the supply of goods and a different set of guarantees which apply in relation to the supply of services. This summary deals only with the guarantees which the Act imposes in relation to the supply of services. TAANZ also has a summary of the guarantees which are imposed by the Act in relation to the supply of goods and if a member has a problem involving the guarantees applicable to supply of goods the member can obtain a copy of that summary by contacting the TAANZ office. Guarantees in Respect of the Supply of Services Where services are supplied to a consumer there are four guarantees provided by Part IV of the Act. These are:- (i) Guarantee as to Reasonable Care and Skill (Section 28). A guarantee that services will be carried out with reasonable skill and care. This guarantee restates in statutory form the existing common law obligations on Travel Agents to exercise the skill and care of a reasonable competent professional travel agent in performing their services. The guarantee does not extend the existing legal obligations of a travel agent to act with reasonable skill and care in the performance of their function on behalf of their customers. Travel Agents had these obligations before the Act was passed. (ii) Guarantee as to Fitness for Particular Purpose (Section 29) A guarantee that the service, and any product resulting from the service, will be reasonably fit for any particular purpose, and of such a nature and quality that it can reasonably be expected to achieve any particular result that the consumer made known to the supplier. This, the second guarantee, is significant and establishes a new liability on travel agents in relation to the performance of services for customers. The Section (Section 29) requires the consumer to have made known his or her purpose to the travel agent at or before the time of making the contract for supply of services for the customer. The difficulty with this particular guarantee is that it is possible that travel agents may be liable for the actions or defaults of other suppliers of product where the other suppliers fail to perform at the levels expected of them. By way of example, if a customer makes known particular needs in terms of a holiday, for example, a resort which contains a golf course and tennis courts, and the travel agent recommends a particular resort as being able to provide those services and facilities, if the resort (for whatever reason) fails to provide those facilities then the travel agent may be liable. Accordingly, this particular guarantee has the capacity to extend the liability of the travel agent to include failures on the part of the suppliers of the actual facilities of travel accommodation. This particular guarantee is modified in part by Section 33 of the Act which states that there shall be no right of redress against a supplier under the Act in respect of a service or any product resulting from a service which fails to comply with that guarantee only as to fitness for particular purpose if it fails to comply with that guarantee only because of any act, or default, or omission of, or any representation made by any person other than the supplier or an agent or servant of the supplier. TAANZ members should nevertheless take special care when they are dealing with a customer who has specified a particular purpose or that the arrangements which are made for him are to have a particular nature or quality or to achieve a particular result. In such cases the travel agent should be aware that if the customer complains that the programme or plan prepared by the travel agent did not satisfy the particular purpose or provide the facilities of the nature and quality specified by the customer then there is considerable potential for the customer to take action against the travel agent pursuant to this particular guarantee. This guarantee will not apply where the circumstances show that the consumer does not rely on the suppliers’ skill or judgment, or, it is unreasonable for the consumer to rely on the suppliers’ skill or judgment. TAANZ members should also ensure that their professional indemnity policy will cover them for breaches of this guarantee in circumstances when they have not been negligent. A more detailed analysis of this section is contained in the case studies which appear at the end of this summary. (iii) Guarantee as to Time of Completion (Section 30) A guarantee that the service will be completed within a reasonable time in any case where the time is not fixed by the contract nor a method for calculating the time provided in the contract. This guarantee is not likely at a practical level to create problems for travel agents. Travel agents do not have problems completing their tasks with a reasonable time frame. Modern technology enables travel agents to carry out reservation and booking work virtually instantaneously and the consumer is frequently advised at the time of enquiry as to whether seats or accommodation are available at the relevant time. (iii) Guarantee as to Price (Section 31) A guarantee that the consumer is not liable to pay to the supplier more than a reasonable price for the service in any case where the price is not fixed in the contract nor a method for calculating the price provided in the contract. When there is failure to comply with this guarantee the consumers right of redress is to refuse to pay more than a reasonable price. Here again the nature of the services provided by travel agents and the basis on which they are remunerated mean that from a practical point of view this guarantee is not likely to be one which affects travel agents in any significant way. Rights of Redress Against Suppliers In Respect of Supply of Services Where the supplier of a service fails to comply with the guarantees a consumer may exercise certain remedies depending on whether the failure can be remedied or not (Section 32). Where a failure can be remedied the consumer may require the supplier to remedy it within a reasonable time. If the supplier neglects or refuses to do so within a reasonable time a consumer may have the failure remedied elsewhere at the suppliers’ cost, or, cancel the contract for the supply of service in accordance with the requirements of the Act. Where a failure cannot be remedied or is of a substantial character the consumer may cancel the contract in accordance with the requirements of the Act or obtain damages in compensation of any reduction in value of the product of a service below the charge paid or payable by the consumer. â€Å"substantial character† is defined in the Act (Section 36). In either situation (can be remedied; cannot be remedied) the consumer can claim damages for any loss reasonably foreseeable as liable to result from the failure. The exception is that no right of redress is available against a supplier in respect of a service or any product resulting from a service which fails to comply with the guarantee as to fitness for a particular purpose (Section 29) or the guarantee as to time for completion (Section 30) if the cause is independent of human control or caused by an act or default or representation made by any person other than the supplier or servant or agent of the supplier (Section 33). Right to Cancellation: Once the right of cancellation has arisen Section 37 of the Act sets out the rules applying to cancellation. Cancellation does not take effect until made known to the supplier, or where it is not reasonably practicable to communicate with the supplier, by means which are reasonable in the circumstances. Cancellation may be made known by words or conduct (Section 37). However, where there is a provision in the contract of supply requiring notice of cancellation in writing this provision will apply (Section 37(3)). Where a consumer cancels a contract for the supply of services the consumer is entitled to a refund of money or other consideration paid less any amount the Court or a Disputes Tribunal orders that the supplier may retain (Section 38). Contracting Out: Section 43 deals expressly with contracting out of the Act. The Act is to have effect notwithstanding any provision to the contrary in any agreement (Section 43). To purport to contract out of the Act is deemed to be an offence under the Fair Trading Act 1986 (a false representation) and fines of up to $200,000 for corporations and $60,000 for individuals may be imposed. The principal exception to the prohibition against contracting out is where the supply of goods or services is to a consumer who acquires the goods or services for business purposes. Where this criteria is satisfied an agreement to contract out of the provisions of the Act must be in writing and record that the supply is for â€Å"business purposes’

The painting has more emphasis on these two philosophers than the others because they are centered in the middle of the composition and they are the only two standing in front of hall entrance with sky surrounding them. Raphael has demonstrated tone in this painting. An example of this is were the light beaming through the windows and creating darkness on the ceiling of the domes. Comparing two Cds Essay Nelly produced 2 CDs called Sweat and Suit. He then made the combination of the two using both CD covers to make one. On the Sweat Cd he portrays himself as a cool gangster. Hes wearing a white beeney hat and a white vest, giving him the image of a sexy, muscular and strong man. The shades and jewellery is giving us an idea that maybe he is an expensive person and loves his money. Also he comes across as if you ever put him on an auction block he wouldnt be sold because he is priceless. The clouds behind him give him the impression that maybe his music does have much of a meaning to him, or it could be implying that during the day he is more of a chilled and relaxed sort of person. Unlike the Sweat CD the Suit backdrop seems to be of a street, which could be implying that maybe his music is more down to earth, and has a lot of meaning, and maybe this is when he gets in his zone and feels the happiest. I also get this impression from his clothes. He is looks more sophisticated, important and in control of everything, just because he is wearing a smart but casual black suit. He still keeps the bling and the hat though as though image is still one of the moist important things to him. These two images of him give us the idea that he might have a split personality, depending on who is around. The neon Nelly attracts your attention almost immediately because of the colour used. This I think is a tactic so his name can get stuck in you head. It also gives the cover a look of a casino or club, giving the cover a welcoming feel. This is different from the Sweat cover because his face grabs your attention first not his name and, his name blends more into the background and is of the same sort of colours. His facial expression on both CD covers and the main one, comes across as mean and serious, as though he is some one that shouldnt be messed with. I think it is a good idea that he has joined both CD covers because instead of just seeing one side of him you can see him as one. This way you can find out whether your assumptions were right or wrong, or whether you can find out anything more about him. The Sweat Suit is very clever as they have brought both the Sweat and the Suit faces to make one. The composition is cunning as well because they have made the face the centre, and main feature of the CD instead of making it smaller and shunting it to one side like they did on the other two albums. This is good because it grabs your attention immediately and stands out. The typography on his hat is like someone who has maybe graffito it and has also made it look gangster. Compared to the Nelly, Prince comes across very differently. Instead of having to guess what he meant by his title he basically spelt it out for you on the CD cover. Everything about it is different; the colours, the graphology and typography. On his Controversy CD he has made himself the centre of attention, but he has made himself small enough so you can see the background, which ties in with the title. He is wearing very 80s style clothing with a marching jacket, a bow tie, a shirt and waistcoat. The colours are very bland and not very exciting, although there are some studs and a brooch attached to the jacket. This shows that maybe they didnt have as much money in those days to spend lavishly or that coloured peoples music wasnt as recognised as it is today. The background is made up of newspaper clippings to do with god and whether you should believe in him or not. This was, and still is going on. Everyone says that you should believe in one type of god and if it isnt his or her god then you are a non-believer. I think this is one of the things he uses as an icon for himself, because it shows that maybe he does a lot towards spreading gods word, or showing everyone that god exists or not. The typography is in big bold writing so it stands out and you can read it easily. Prince is coloured in pink, and is positioned away from the image of him in the top right hand corner, right out of the way. His Emancipation Cd however is very different. It was only made ten yrs later but it is more alive and colourful. The composition is set out in a very clever and crafty way. In the centre of the CD cover is a picture of an elaborate male sex sign surrounded by chains. At the bottom of the cover there are two fists held up in the air. These could be symbolising either someone punching their fists up in the air because they know that they are now free, or they could be putting them up as if to get arrested. The fiery colours in the background could be expressing the persons feeling of anger or stress. During the last 30 decades I think the popularity of black solo artists has increased no matter what style of music it is. The Work Of Milton Glaser Arts Essay Milton Glaser, was born in 1929 in New York, he attended the High School of Music Art. Known for his influential dynamic design, three of his most famous works include the I love New York logo, Bob Dylan poster and DC bullet logo, designed for DC Comics. Glaser has worked for a variety of agencies, designers, illustrators and co-founded Push Pin Studios in 1954. In 1977, Milton Glaser designed the I heart New York poster, unbeknown to him that it is this piece of design that would define his life. As a very simple piece of design to the eye, it holds a very clever message, Glaser explains how the design is to be translated to be fully understood, he says that, to understand the design you have to translate it. First of all you have to figure out that the I is a complete word, then you have to figure out that the heart is a symbol for an experience, then you have to figure out that NY are the initials for a place he then goes onto say that the issue in all communication is moving the brain, and puzzles move the brain, this then makes people feel good because they have solved the problem, just like this logo. The logo was designed to promote tourism in New York City and then became the trademark of the New York State. Glaser did the work pro bono as he only expected the campaign for more tourism to last a few months; never did he think it woul d have gone global, as this was not his original intention. However, the logo was a major success and has become so iconic worldwide and has been and still continues to be sold for years. The logo, then became furthermore prominent during the aftermath of the 911 terror attacks, as Glaser added a black smudge to the bottom corner of the heart symbolising a wound and a wounded heart is important to attain healing, and to acknowledge pain, despite this though the Department of Commerce were sceptic to adopt the creation which is why Glaser sent the new logo to New York Daily News, circulation close to a million copies around the city and the added the extra words more than ever, it helped create a sense of unity between the population and an awareness of support from visitors. Glaser has always craved being, new, original and inventive using a variety of historical and visual references, he stated my sense is not to be allergic to style or mores in time, he says. The best example of this from Glaser is probably the album insert designed for Bob Dylan in 1967, the use of jarring historical references allows a sense of inventiveness. Being versatile and flexible with media and styles is a must; I absolutely admire experimentation, as well as delving into various visual styles and media. The use of technology in design is great, yet the more conventional and traditional styles are truly something to treasure, these are a big passion of mine. Combining traditional media and technology together really does enable a stronger connection and context with the audience, as much as I appreciate how the usage of technology has greatly helped the development of design tremendously, it seems as though conventional design is a sign of the past, this needs reviving! It is stated by Glaser that whether simple or complex design is integrated into a piece, communicating a clear opinion, message or view to the prospective audience. To design is to communicate clearly by whatever means you can control or master, design should do what it is designed to do, whether thats inform, shock or persuade people as an example . However, design is definitely beyond reading; colour, layout and shape recognition all have a selective purpose, for example road signs are very legible yet out of date in relation to current generations and social conditions and therefore should be changed, yet humans are very reluctant to change and prefer to stay conformed to conventional design. This then idea of being conformed is because people are scared of change, yet when that change becomes conventional overtime it is then a norm. Glaser felt that whilst working for Push Pin studios, that he became imprisoned by its reputation, and I wanted to try and invent a new ambiguous rep utation, leaving the agency to build up his own strong reputation. Glaser is a very ambitious individual, this is definitely something to idolize, not being scared or worried about other peoples views on what he produces or the context that surrounds it. Computers are to design as microwaves are to cooking, what a great statement! Design is an art whether a piece takes hours, days, months, weeks or even years, it is very precious. As a simple analogy, a microwave is an electrical appliance that uses technology to reheat and cook food; computers as technology lower the standard, classic knowledge as well as the craft of design. The definition of a designer seems to have become more blurred. The accessibility of technology now means that anyone with a computer and the correct software can become a designer. This has both negative and positive effects; on one hand, poorly considered, non-disciplined design is now being allowed to flow through the public consciousness. On the other hand, we are seeing new, forward thing, unrestricted creative thinking from those who are not restrained by traditional formalities. Craft allows technology to be exploited effectively. Therefore the continuation of taught craft in academic institutions is essential to sustaining graphic design as a profession. The use of technology has vastly helped revolutionise design, I do not disagree there and to run a design office, computers are necessary along with traditional skills. Having amazing artistic abilities and a range of experience is in most cases what is clarified as a designer, yet I do not believe this is how a designer should be classified, I understand that various skill sets are required to be clarified as a graphic designer. I believe in using a variety of styles, dependent upon which area of design Im working on and what purpose the design has. My styles seem to have become more varied in the last couple of years, which is great, becoming too rounded on a particular style is good, if wanting to familiarize people to easily recognise a defined style and the designer, but then having that comfort of working in one style I feel makes people become conformed to that one and only style, not allowing any room for change, just how us humans work in general, we dont like change, having a variety of rounded styles is great and something I definitely believe in. When I work on HTML and websites, I really do prefer to be minimalistic, ordered and very structured enabling a good usability for browsers, yet this may be seen more for purpose than design as I do not like over complex websites that confuse the browser. However, when designing a piece of work purely around fine art, my thought is exactly the opposite, I adore being slightly abstract and bright, bold colours. I do this as I find art truly is a form of expression and communication, just how Glaser states that communication is all about moving the brain, which is done through puzzles, so when someone can identify what a piece of work is and they feel good they have done this, it shows there is effective communication and expression in a piece of work. Typography is not really one of my strong suits, but I really do have to acknowledge the importance of its use amongst design. It is typically questioned whether there are currently too many fonts, as there are hundreds and possibly thousands of websites that offer free fonts for download. I disagree with the statement that there are too many fonts, as it really is the understanding of the fonts that is lacked these days. Having this knowledge can really define the difference between a good and excellent designer I feel. Understanding and knowing the main fonts, font families and the use of line height, kerning and tracking is very important in any area of design, if a designer is not aware of any of these aspects of typography, knowing when and how to use them may become ineffective, as the art of typography is to communicate efficiently and therefore has be clean, legible and well designed, knowing the basics is essential. I really aspire to travel wherever design takes me, and experience a bit of everything. I have my strong suits and my weak suits, but there is so much I want to learn. I am very good at fine art practice and thoroughly enjoy this; this is because it is a very way for me to communicate with people without using words. As well as this, the amount of historical and current influences that inspire my work is vast, I enjoy combining influences to create a mixed piece of design, this may be seen as unconventional and wrong but the possibilities within design are endless, as Glaser states my sense is not to be allergic to style or mores in time, just my thoughts exactly, I really enjoy combining styles and references. There are other areas of design which Im not that keen on, as for example, web design, web design really does interest me, yet frustrates me at the same time because of the careful consideration of code that is needed, despite this though, I understand that the web is booming and will continue to do so, the need for online advertising is currently enormous in any market, I know this and this is an area which I am currently extending my practices on, as web design is very important and influential in the current twenty first century. Web design isnt the only practice that I feel will continue to grow hugely, the need of branding is getting ever more so diverse along with the use of complex applications for smart phones, smartphones are certainly taking off and such big developments in design have been made in the past five years, the current rate of change in design is rapid, and becoming even more complex each year. The String Around My Finger I work in a restaurant as a waitress and several days ago a co-worker of mine had to leave work. His ex-wife had called to tell him that their daughter had been rushed to the hospital because of a bicycling accident. He wasn't sure quite what to do. He'd talked to me before he asked the manager for permission to leave. He doubted that it was serious enough to get permission and asked whether or not I thought he should try. I told him that he had to go, and that I thought it was very important that he and his ex-wife be by her side especially considering their recent divorce. From my own experience, I knew that simply having both of my parents come to my aide reinforced the idea that my parents were the ones that got divorced and that, even if they weren't living together, they both would always be there for me. My parents got divorced when I was two and my younger sister just six months. My sister and I lived with our mother would visit our father two weekends a month and over summer vacation the situation was reversed. As we grew older, our enthusiasm towards those visits with our father waned because, after all, all of our friends were in our neighborhood. We frequently missed friends' birthday parties to visit him. Inevitably however, we always had a great time and were sad when our visits were over and yet happy to come home. I'd be lying if I said that I never wished that they would get back together and that there were never any times I couldn't wait to show my father what I'd done in art class or a great math test I was particularly proud of. Maybe it was for that reason that as a child I couldn't help feeling slightly abandoned even though he never missed a visit. I thought I'd outgrown that feeling when I was seven and a big first grader. It wasn't until that feeling had vanished that I realized I'd still felt that way. I was in the fourth grade when that happened. My mother picked us up from our father's on Sunday evenings. On the ride home she told me she had a surprise for me. I knew that she'd rearranged our rooms (she did that all the time; she used to want to be an interior decorator), so I couldn't imagine what my surprise could be.

Icon of Nuestra Senora de Guadalupe is also known as Our Lady of Guadalupe or the Virgin of Guadalupe. It is a most famous and most popular Roman Catholic image of a Virgin Mary in Mexico. The legend says that Virgin appeared to Juan Diego Cuauhtlatoatzin, an Indian convert, in 1531 and the witness of that miracle required commemorating it by erection of a church, known as a Basilica of Our Lady of Guadalupe.  There were two apparitions of the Virgin Mary and after the second an icon was painted which is, actually, now one of the most famous in Mexico. This event was historically significant as following it a great number of Indians of Mexico converted into Christianity. According to the information provided in encyclopedia Britannica â€Å"in 1754 a papal bull made the Virgin of Guadalupe the patroness and protector of New Spain, and in 1810 she became the symbol of the Mexican independence movement when the patriot-priest Miguel Hidalgo y Costilla raised her picture to his banne r.† (Encyclopedia Britannica)The story of Virgin’s apparition is derived from the Nican mopohua which is thought to be the original source of that event.   Nican mopohua, written in the indigenous Nahuatl language gives an account of the encounter between Virgin Maria and Juan Diego Cuauhtlatoatzin in 1531 on Tepeyac. It says that a widowed convert Juan Diego was traveling to â€Å"attend to divine things† the woman in a bright shine appeared in front of him and said that she was a mother of God and asked Diego to tell the Bishop about her request to build a temple on this hill. She promised to come to those people who, would pray in this temple, and help them.The Nican mopohua is not the only work related to the apparition but it is considered to be the most explicit and most trusted. There is another work relating this story, but this time it is the first Spanish-language apparition account written by Miguel Sanchez. It is this document that for the first tim e refers to Our Lady of Guadalupe as to a symbol of Mexico. He mentions it in the context that â€Å"this New World has been won and conquered by the hand of the Virgin Mary†¦[who had] prepared, disposed, and contrived her exquisite likeness in this her Mexican land, which was conquered for such a glorious purpose, won that there should appear so Mexican an image† (Brading 2001).When in 1810 Miguel Hidalgo y Costilla and his army fought for the independence of Mexico they used the image of Nuestra Senora de Guadalupe as a sign on their clothes and also as an insignia of their campaign. After Hidalgo’s death a mestizo priest led the army during revolution. He also relied on the holy image and as Krauze in his book states he was confirmed that â€Å"New Spain puts less faith in its own efforts than in the power of God and the intercession of its Blessed Mother, who appeared within the precincts of Tepeyac as the miraculous image of Guadalupe that had come to comfor t us, defend us, visibly be our protection† (Krauze, 1997).The Mexican calendar even contains the holiday to honor the Virgin, that is December 12, inscribed by the priest-revolutionary. (Matovina, 2001) Thus during the independence struggle people treated Nuestra Senora de Guadalupe as the symbol and patroness of patriots. They offered up numerous prayers at moments of difficulties and used her image on their ensigns. In this way, Brading observes, political exaltation intervened with religious faith â€Å"to produce a vehement fervor in favor of the sacred cause of liberty. The veneration for this image in Mexico far exceeds the greatest reverence that the shrewdest prophet might inspire† (Brading, 2001). In this way the icon of Nuestra Senora de Guadalupe became not only the sacred symbol of Mexico but also it acquired a profound political implication, the embodiment of the struggle for the independence, so desired by the Mexican people.Though there are still a lot o f disputes as regards the verity of the legend about Our Lady of Guadalupe’s apparition its authority still remains very strong in Mexico. In addition to the reputation of the image which inspired people to fight for independence the Virgin is also the symbol of Catholicism in Mexico. The image of Our Lady of Guadalupe said to have been miraculously imprinted upon Juan Diego's cloak is displayed there.The woman depicted in this image dresses and looks like an Aztec maiden of the early 16th century. These symbols reinforce the indexical and iconic connections between Our Lady of Guadalupe and the non-Christian religious traditions of the Aztecs. That the Virgin is pregnant is also indicated by the black sash she wears around her waste, an Aztec symbol of pregnancy (Castillo, 1995). Located just below the sash is another floral symbol, the nagvioli. According to Castillo, this flower â€Å"represented Huitzilopochtli, the great ferocious sun god of the Aztecs† (p. xix). Our Lady of Guadalupe is thus symbolically linked to Coatlicue, an aspect of the goddess Tonantzin, who was the mother of Huitzilopochtli. In the summary given, theory of life is said to have risen from the primitive earth’s atmosphere. The atmosphere of the early earth is said to have many carbon dioxides but no oxygen. These carbon dioxides will act as reactants in order to create much more complex organic substances such as proteins, carbohydrates lipids, phospholipids, and nucleotides. The said substances are well known as the building blocks of life. This is the evidence that supports their claim that life originated from the gases present in the early earth’s atmosphere. Also to support their claims, an experiment during the early 1950’s would confirm that it is true that simple carbon based compounds can naturally be created under the environment of the primitive earth. In other readings, the early life is said to have also talks about the building blocks of life. The Panspermia theory proposed that these building blocks of life would have originated outside of the earth. These building blocks or the ‘seed of life’ might be scattered around the galaxy or even the universe. Also the same as the summary in piecing it together, the panspermia theory suggests that whenever conditions are met, the building blocks of life will grow and develop. The only downfall of the theory is that, since the building blocks of life came from outside the earth, then there is a great possibility that other life may form from outside of the earth. Evidence of this theory is that, a certain bacteria were discovered in the earth’s upper atmosphere. What’s interesting with the discovery is that the bacteria were similar to the bacteria found in the earth. The bacteria might brought by the space crafts that left the earth. But still, there is a probability that the bacteria would have evolved from outside of the earth. Unfortunately, this theory is lacking in evidence. Some scientists are still on the verge of research in order to prove that their claims were right (Backman, 2007). The summary has a basis about its claims of the origin of life. But problems arise. The origin of the earth is still not established very well. It is said in the summary that substances from the early earth will evolve but the existence of the early earth is not yet been proved. Both the theories lack evidence to support claims of the origin of life.

After reading the essay and gaining queries and facts on the writing task, one must now apply the different pre-writing strategies to make the desired composition. Dolly became artificially produced clone and proof that cloning large animals like sheep or humans would be possible. More importantly perhaps, Dolly raises many different sorts of important questions for human beings. Human cloning has been met with widespread unease all over the world and generated a series of ethical issues that will be discussed in this paper. Main Body In opposition to productive cloning it is asserted that the method would be causing danger to human beings. For example, Dr Harry Griffin, the director of the Roslin Institute, Scotland, that successfully cloned Dolly the sheep indicates that: It would be irresponsible to try and clone a human being, given the present state of the technology†¦. It may be possible that any child born as a result of nuclear somatic transfer cloning will experience disadvantage either because he/she is robbed of his/her genetic identity or because he/ she will not have an open future (Harris 1998, p. 169). To what extent is a cloned person robbed of his/her genetic identity? While most human beings are genetically unique, there seems to be no indication that permitting the birth of genetically identical twins derived from a single fertilized ovum robs anyone of their genetic identity or even that the fact that twins of this kind share a genetic identity is causing harm to these individuals. It could be stated, therefore, that it thus seems not clear why this factor should make human cloning unethical. It has been indicated (Holm, 1998) that clones created by means of nuclear somatic transfer cloning will live their lives in the shadow of their older genetic twin. As a result, the clones will not have the open future that most of ordinary people have and, it might be argued, human beings have a right to. Soren Holm, for example, argues that: Usually when a child is born we ask hypothetical questions like How will it develop? or What kind of person will it become? and we often answer them with reference to various psychological traits we can identify in the biological mother or father or in their families†¦In the case of the clone we are, however, likely to give much more specific answers to such questions. This means that while people usually claim for the importance of the moral principles of respect for individual autonomy or the power to make a decision for oneself without influence from outside, people are violating these principles by robbing clones this opportunity to live their lives in the way they want. The way the clones were produced will putt them in a position where they are living in a shadow. However, even if this claim is true that clones would live in the shadow of their genetic originals, it is not obvious that this fact should compel people to prohibit human cloning. Arguments that compel people to consider the well-being of a resulting child are questionable. It has been claimed that a person is only wronged by being brought to birth if he/she has a life so bad that it would be a cruelty rather than a kindness to bring it into existence (Bennett and Harris, 2002, p. 323). This kind of unfortunate existence is sometimes characterized as an unworthwhile life. An unworthwhile life would be a life of extremely negative experience and worsening. Other lives that may be not perfect, but not so worthless as to deprive that individual of an amazing experience of living, are termed worthwhile lives. In this regard, the statement is that as long as a person is likely to have a worthwhile life he/she is not disadvantaged by being brought to birth. Thus, even if a human clone is likely to have a life that is somehow less than ideal, his or her suffering is unlikely to be such that it makes life unworthwhile. It could therefore be claimed that while being born a clone may not be the ideal way of coming into the world, it is the only opportunity of existing in this world and to have a life that is likely to be worth living. If this position was considered, it would establish human cloning as ethically acceptable at least on the grounds of giving the child a right to exist. Conclusion The topic human cloning has a number of ethically puzzling if not problematic features. Cloning will be one of the most hotly debated and least well-understood phenomena in near future.
